Indemnification & Hold Harmless Agreement

Club MASHOut is holding the Mid-Atlantic States Homebrewers Campout (MASHOUT) on August 18-22, 2022. In consideration for permission to enter the private property where MASHOUT is held, I hereby agree to the following:

• I understand that this is an outdoor activity and that there could be injuries or discomfort from the elements, animals, plants, and insects.
• I understand that there will be campfires and other objects that could cause burns.
• I understand that the ground is uneven and that there will be tent stakes, guy-wires and other objects that pose navigation and tripping hazards.
• I understand that alcohol will be available to participants on a self-serve basis. I am solely responsible for preventing any members of my party under age 21 from consuming alcoholic beverages.
• I understand that drinking alcohol and operating a motor vehicle under the influence of alcohol are not consistent with the law and public safety.
• I understand that excessive alcohol consumption may lead to serious health consequences for me, my family, and any minor guests, up to and including death.
• The event will be held come at your own risk and it will be expected of people to be sensible and responsible with precautions in light of the Covid epidemic.

Accordingly, I hereby agree to indemnify and hold harmless Club MASHOut, its members and officers (collectively “Club MASHOut”), the members and officers of the Free State Homebrew Club Guild (collectively “FSHCG” as additional event sponsors), and the property owners Sean McCagh (the “Property Owners”) from any and all liability and harm arising from my activities and those of my family and minor guests related to MASHOUT, including travel to and from the event (“my MASHOUT activities”). As part of my indemnification of Club MASHOut, FSHCG, and the Property Owners, I will defend all against any threatened or filed legal action related to my MASHOUT activities, and will pay all legal fees, fines, judgments, and other costs incurred by them. This indemnification applies to any action threatened or taken by me, my family, minor guests, heirs, and executors or by third parties who allege that they were injured by me, my family, or minor guests. My indemnification obligation includes payment of all attorneys fees; should I fail to provide a defense, Club MASHOut, FSHCG, and/or the Property Owners may defend themselves and I will be responsible for paying all legal fees, fines, judgments, and other costs incurred by them.

I knowingly assume the risks inherent in my MASHOUT activities. I hereby release Club MASHOut, FSHCG, and the Property Owners from any claims I might have against them related to my MASHOUT activities.

This agreement is binding upon me, my heirs, and my executors.
